Consent to personal data processing

In accordance with Federal Law No. 152-FZ “On Personal Data” dated 27.07.2006, of my own free will and volition and in my interest I hereby express my unconditional consent to processing of the personal data to the person registered pursuant to the legislation of the RF at the address:

Personal data is any information related to the individual identified or to be identified on the grounds of such information.

This consent has been given by me for processing of the following personal data:

• Name;
• Surname;
• Phone;
• E-mail;
• Comments;

The consent has been given to the Operator for performance of the following actions with my personal data using automation facilities and/or without using such facilities: gathering, systematization, accumulation, storage, specification (updating, amendment), use, depersonalization as well as performance of any other actions stipulated by the legislation of the RF both by automated and non-automated methods.

This consent is given to the Operator for processing of my personal data for the following purposes:

• provision of services/works to me;
• sending of notices relating to the provided services/works to me;
• preparation and sending of responses to my inquiries;
• sending of information to my address, including advertising information, about the Operator’s events/goods/services/works.

This consent shall be valid until it is withdrawn by a relevant notice sent to the electronic address: fortuna@fortuna.vodka. In case of withdrawal of the consent for personal data processing by me the Operator shall be entitled to continue personal data processing without my consent in case of the existing grounds stated in items 2-11 part 1 clause 6, part 2 clause 10 and part 2 clause 11 of Federal Law No. 152-FZ “On Personal Data” dated 26.06.2006.

Clause 9. Consent of the personal data subject to processing of his personal data

1. A personal data subject shall take the decision on provision of his personal data and shall give his consent to their being processed without duress, by his own will and in his own interest. The consent to the processing of personal data shall be specified, well-informed and in full awareness. The consent to the processing of personal data may be given by the personal data subject or a representative thereof in any form that allows to acknowledge that is has been obtained, except as otherwise established by a federal law. If the consent to the processing of personal data is obtained from a representative of the personal data subject, the powers of that representative to give consent on behalf of the personal data subject shall be verified by the operator.
2. The consent to the processing of personal data may be revoked by the personal data subject. If the consent to the processing of personal data is revoked by the personal data subject, the operator is entitled to keep processing the personal data without the consent of the personal data subject if there are the grounds described in items 2 - 11 part 1 clause 6, part 2 clause 10 and part 2 clause 11 of this Federal Law.
3. The duty to provide evidence of the obtained consent of the personal data subject to his personal data processing or evidence of the existence of the grounds described in items 2 - 11 part 1 clause 6, part 2 clause 10 and part 2 clause 11 of this Federal Law is vested in the operator.
4. In the cases envisaged by the federal law, personal data are processed only with the written consent of the personal data subject. The following shall qualify as consent in writing on a paper medium of a personal data subject containing the autograph signature of the personal data subject: consent filed as an electronic document signed in accordance with the federal law by means of an electronic signature. The consent in writing of the personal data subject to his personal data processing shall, in particular, include the following:
   
   • 1) the surname, first name, patronymic and address of the personal data subject, the number of his main personal identification document, the date of issue of said document and information on the body that has issued it;
   • 2) the surname, first name, patronymic and address of the representative of the personal data subject, the number of his main personal identity document, the date of issue of said document and information on the body that has issued it, the details of the power of attorney or the other document confirming the powers of that representative (if the consent is received from a representative of the personal data subject);
   • 3) the name or the surname, first name, patronymic and address of the operator which seeks the consent of the personal data subject;
   • 4) the purpose of processing the personal data;
   • 5) a list of the pieces of personal data to the processing of which the consent of the personal data subject is given;
   • 6) the name or the surname, first name, patronymic and address of the person that processes the personal data on the operator's assignment, if such person is going to be entrusted with the processing;
   • 7) a list of the actions involving the personal data to the commission of which the consent is given and a general description of the personal data processing techniques used by the operator;
   • 8) the effective term of the consent of the personal data subject and also the manner in which it may be revoked, except as otherwise established by the federal law;
   • 9) the signature of the personal data subject.
5. The procedure for getting the consent of the personal data subject in the form of an electronic document to his personal data processing for the purposes of providing state and municipal services and also the services deemed necessary and compulsory for the purposes of providing state and municipal services shall be established by the Government of the Russian Federation.
6. If the personal data subject is legally incapable, the consent to his personal data processing shall be given by a legal representative of the personal data subject.
7. In the event of death of the personal data subject the consent to his personal data processing shall be given by the heirs of the personal data subject, unless such consent was given by the personal data subject during his life.
8. Personal data may be received by the operator from a person other than the personal data subject, if the operator is provided with evidence of the existence of the grounds mentioned in items 2 - 11 part 1 clause 6, part 2 clause 10 and part 2 clause 11 of this Federal Law.
